My primary objective is to ensure that my customers have a wonderful experience. I would therefore ask you to read the following General Terms & Conditions carefully as they regulate the legal relationship between you and Anouk’s Getaways.

Article 1: SPECIAL FEATURES

The present General Terms & Conditions supplement the prior information communicated to the customer before his/her booking, pursuant to articles L. 211-8 and R. 211-4 of the French Code of Tourism applicable on 1st July 2018, and inform the customer of the conditions under which ANOUK MATEO offers her services.

The pre-contractual information forms an integral part of the contract concluded but may be subject to change before the order form is signed on the following points: the main characteristics of the trip (transport, accommodation, timetables, stopovers, itineraries, etc. within the meaning of article R. 211-4-1°), the price, and the number of persons on the trip and the cancellation costs.

The customer acknowledges that he/she has received and taken note of these General Terms & Conditions in their entirety, as well as of all the terms of the preliminary offer (quotation, programme) drawn up by ANOUK MATEO before signing
the order form.

Any modification to the preliminary offer shall be clearly communicated by email to the customer prior to the conclusion of the contract.

Number of customers: ANOUK MATEO may only carry a maximum of 4 passengers in her vehicle (3 adults and a minor or 4 adults of small stature, the middle rear seat being less spacious).

The customer acknowledges that he/she has the capacity to enter into a contract when booking the services offered by ANOUK MATEO.

If one of the clauses of these Conditions is or becomes illegal, null and void or without object with regard to the regulations in force or a final court decision, it will be declared unwritten and the other provisions will remain legal and
opposable to the parties.

Article 2: PRICE

The price is indicated in euros for each service offered by ANOUK MATEO. No VAT is applicable, as Anouk MATEO operates as an auto-entrepreneur.

Any change in price subsequent to the publication of these General Terms & Conditions will be notified to the customer in a clear, comprehensible and visible manner on the revised order form.

Article 3: ACCEPTANCE OF THE OFFER: SIGNING OF THE ORDER FORM

For each of the proposed excursions, the acceptance of the offer by the customer is materialised by the validation of the order form sent by ANOUK MATEO.

Article 4: CHANGES OR CANCELLATION BY THE CUSTOMER

All requests for cancellation must be sent by email to the following email address: contact@anouksgetaways.com

– Cancellation without charge more than 7 days before the date of the service

– Cancellation less than 7 days before the date of the service: cost of 25% of the service amount

In the event of a change in the service, if the replacement service is of a higher value, the customer will have to bear the additional costs.

Any delay on the part of the client must be reported as soon as possible to ANOUK MATEO. Depending on the delay, it might result in the modification of the scheduled programme without refund.

Article 5: CHANGES OR CANCELLATION BY ANOUK MATEO

If under exceptional and unavoidable circumstances, ANOUK MATEO is prevented from carrying out the contract, she will notify the customer as soon as possible and will refund the totality of the sums paid within 14 days of the cancellation of the contract, unless a new date for the excursion is agreed upon.

Article 6: PAYMENT

The customer must pay by bank transfer 25% of the amount of the invoice when accepting the order form proposed by ANOUK MATEO. The rest of the amount (the remaining 75%) shall be paid directly to Anouk MATEO on the day of the excursion.

The validation by the client of the order form referred to in Article 3 above shall constitute acceptance by the client of the payment of the full price corresponding to the order. In the event that the payment proves to be irregular, incomplete or non-existent, for any reason whatsoever, and the services are not paid for within the stipulated period, the provision of the services shall be suspended and the costs incurred shall be borne by the client.

Validation of the order form is binding on ANOUK MATEO, subject to payment of the services provided, and this within the time limit initially set.

Article 7: FORMALITIES

For all services offered by ANOUK MATEO and governed by these General Terms & Conditions, the customer must be in possession of at least one valid identity document: passport (and visa if required) or national identity card.

Article 8: RESPONSIBILITY OF ANOUK MATEO

ANOUK MATEO is liable to the customer for the proper performance of the services described in the order form. However, she may be exempted from all or part of her liability by proving that the non-conformity isattributable either to the customer or to a third party outside the supply of the services provided for in the contract and is of an unforeseeable or
unavoidable nature (situations beyond the control of the party invoking it and the consequences of which could not have been avoided even if the party had been able to take all reasonable measures, and which prevent the fulfilment of all or part of the obligations provided for in the contract. Examples: strikes, riots and any prohibition whatsoever issued by the governmental or public authorities, exceptional climatic conditions…), within the meaning of Article L. 211-16 of the French Code of Tourism.

ANOUK MATEO may not be held liable for any non-conformity of services purchased on the customer’s initiative and outside the contract.

ANOUK MATEO may not be held liable for any thefts that may be committed in the places visited (restaurants, museums, tourist sites, etc.) within the limits set by article 1953 of the Civil Code. ANOUK MATEO cannot be held responsible for objects or clothing lost or forgotten during a service.

The transport service offered by ANOUK MATEO, governed by these General Terms & Conditions, is covered by civil liability insurance in accordance with the laws in force. ANOUK MATEO is legally authorised to operate as a VTC driver.

Article 9: INSURANCE

ANOUK MATEO has taken out an insurance policy with the Mutuelle Fraternelle d’Assurances Group, guaranteeing her professional civil liability.

ANOUK MATEO advises foreign visitors to take an additional insurance for repatriation and medical assistance, cancellation, interruption of stay and luggage loss, prior to their arrival in France.

Article 10: PROTECTION OF PERSONAL INFORMATION

ANOUK MATEO collects the personal data of her customers for the purpose of the proper execution of the contract entered into.

The approval of the present General Terms & Conditions allow the use of personal data in order to ensure proper communication between ANOUK MATEO and the customer and in order to be included in ANOUK MATEO’s customer file.

In accordance with the General Data Protection Regulation (RGPD), the customer has the right to access, rectify and delete his/her data at any time. In this case, he must send his request by e-mail to contact@anouksgetaways.com.
